The defense team of former President Yoon Suk-yeol confirmed on the 19th that they had requested bail from the court, arguing, “If trials proceed four times a week while in detention, it would be fundamentally impossible to prepare for cross-examination or ensure normal trial proceedings,” and asked to be released to stand trial. This comes as additional charges are expected from not only the special counsel team investigating the rebellion case but also the special counsel team probing former first lady Kim Keon-hee and the special counsel team investigating the Marine’s death. The defense claims that standing trial in detention would make it impossible to exercise the right to defense.

According to sources familiar with the matter on the 22nd, Yoon’s legal team submitted a bail request to Seoul Central District Court’s Criminal Division 35 (Judge Baek Dae-hyun), which is handling the trial for charges including obstruction of official duties, newly indicted by the rebellion special counsel team. In the request, Yoon’s side stated, “While the rebellion case trial is currently held once a week, considering additional cases expected from the special counsel team investigating former first lady Kim Keon-hee and the special counsel team investigating the Marine’s death, trials are anticipated to proceed at least four times a week.” Yoon is also standing trial for rebellion charges at Seoul Central District Court’s Criminal Division 25 (Judge Jee Kui-youn), indicted by the prosecution’s special investigation unit. The special counsel team investigating former first lady Kim Keon-hee is probing allegations such as the “Myung Tae-kyun nomination interference,” while the special counsel team investigating the Marine’s death is looking into the “external pressure on the investigation into the Marine’s death” and is highly likely to indict Yoon additionally.

The defense argues that if the special counsel teams proceed with additional indictments, Yoon, in detention, would be unable to adequately prepare for trials. The rebellion trial typically starts around 10:15 a.m. and often ends after 6 p.m., but detained defendants face restrictions on meeting lawyers, making thorough preparation difficult.

Meanwhile, the rebellion special counsel team has summoned Yoon on the 24th. His legal team described this as a “murderous schedule” and argued in the bail request, “The constitutional fundamental right and core procedural right of ‘defense’ are not being guaranteed at all.”

The defense also requested the court to consider Yoon’s health, noting he suffers from complications due to type 2 diabetes. They stated he is currently at risk of blindness and in a situation where survival itself is a concern. According to a medical certificate issued by Seoul National University Hospital on July 28 of last year, Yoon has type 2 diabetes, hypercholesterolemia, carotid artery stenosis, cardiovascular disease, diabetic retinopathy, and macular edema, with a risk of blindness due to diabetic retinopathy, requiring careful management.

However, Yoon has not attended the rebellion trial since his detention and indictment by the rebellion special counsel team and has also refused to respond to summons from the special counsel team investigating former first lady Kim Keon-hee, sparking controversy. The controversy grew when it was revealed that Yoon resisted forced transportation in his underwear during an attempt by the special counsel team investigating former first lady Kim Keon-hee to bring him in at Seoul Detention Center. In response, the defense stated, “If bail is granted, Yoon plans to faithfully attend all future trials and provide thorough explanations in court.”

Additionally, the defense argued that the rebellion special counsel team’s additional indictment on July 28 “may constitute double jeopardy.” The team views Yoon’s alleged abuse of authority—such as infringing on the Cabinet’s deliberation rights during the declaration of martial law and ordering false public announcements—as a separate offense. However, the defense contends this is part of the existing rebellion charges and does not form a separate crime.

The defense urged the court, “We ask you to consider the importance of exercising the right to defense” and “make a fair judgment based on law and principle.” The bail hearing date for Yoon has not yet been set.
