Adu-Boahene Seeks to Obtain the Witness' Interrogation Audio

A court in Accra has directed the Economic and Organised Crime Office (EOCO) to make public the audio files from the questioning of Edith Ruby Opokua Adumuah, the prosecution's second witness in the case against former National Signals Bureau (NSB) Director-General Kwabena Adu-Boahene, who is charged with embezzling GH₵41.9 million from the government.

This came after the witness acknowledged during cross-examination that she was invited and questioned by EOCO officers as part of an inquiry into the acquisition of Cyber Security equipment for the National Security Council.

"Did they inform you when you entered the EOCO premises that the interrogation is being recorded, is that not correct?" Samuel Atta Akyea, representing Adu-Boahene, questioned the witness.

Madam Adumuah, the Finance Director at NSB, replied, "Yes, Your Honor."

It was at this moment that Mr. Atta Akyea asked the court to compel EOCO to disclose the audio of the interrogation, pointing out that "it will demonstrate that the witness made statements that support our case."

The proposal was contested by Deputy Attorney General, Dr. Dominic Srem-Sai, who stated that the topic of the request fails to meet the criteria for additional release.

He mentioned that the basis for additional disclosures is the Supreme Court's "well-considered judgment in Baffoe-Bonnie, which this court examined in its scholarly, exceptionally flawless decision, emphasizing that relevance is a crucial factor in assessing a request for further disclosure."

He also stated that there was no evidence suggesting the interrogation was actually recorded, as the witness had only informed the court that she was told the interrogation was being recorded.

Mr. Atta Akyea, in a pointed reply, cited Section 2(1)(g) of the practice direction, which specifies that disclosed materials encompass audio recordings.

He further stated that rejecting the audio recording would be equivalent to hiding evidence in violation of the law's explicit requirement that exculpatory evidence be made available for use, regardless of whether the Attorney General has provided it or not.

"I ask that the objection be dismissed to allow for more information to be revealed, so that in the best interest of justice, Your Lordship will be aware of what was discussed at EOCO and what is being said here," Mr. Atta Akyea added.

The court, led by Justice Eugene Nyante Nyadu, issued a brief decision directing the release of any existing audio recording.

The court stated that it needs to be submitted as an additional disclosure by the end of the day on November 13, 2025.

Mr. Adu-Boahene is appearing in court alongside his wife, Angela Adjei-Boateng, accused of stealing GH₵49.1 million from the government in a supposed agreement to acquire a cybersecurity system for the nation.

They are being charged with 11 allegations including conspiracy to commit offenses, theft, misuse of public office for personal gain, money laundering, and inflicting financial damage on the state.

As stated in the prosecution's submission to the court, Mr. Adu-Boahene transferred public funds into a personal bank account, which he utilized to acquire several real estate properties, including those for which he requested the disclosures.
