A High Court in Ekiti State, located in Ado Ekiti, handed down death sentences to seven individuals for the crime of armed robbery on Thursday.
Two of the seven individuals – Oyebanji Jimoh (32) and Jimoh Azeez (32) – had previously received the death penalty from a different judge in connection with a separate armed robbery case.
The other five individuals are Bolaji Ayodele Stephen (32), Ibrahim Alausa (33), Olorunfemi Busayo (32), Adeniyi Adewumi (30), and Idowu Sunday (32).
Seven individuals were charged on January 28, 2020, with five offenses related to conspiracy, armed robbery, and involvement in a secret organization.
The accusation stated, "On October 15, 2018, in Ado Ekiti, the defendants stole from Ologunleko Olayinka a Toyota vehicle with registration number SMK 837 BF, N150,000, a laptop, and mobile phones."
On the same day at the Dallimore junction in Ado Ekiti, they stole one Ologunleko Oluwole's phones, food items, and some personal items.
On 15 July 2018, at Ifelodun Avenue, Dallimore Street, Ado Ekiti, the defendants stole one Ojo Babatunde Kolawole's phones. On 15 October 2019, it was established that the defendants were part of the Eiye Confraternity, a banned secret group in Ekiti State. At the time of the incident, they were carrying guns and axes.
The charges state that the offenses violate Sections 6(b) and 1(2)(9) of the Robbery and Firearms (Special Provision) Act, Cap. R11, Vol. 14, Laws of the Federation of Nigeria, 2004, and Section 4(1) of the Secret Cult (Abolition and Prohibition) (First Amendment) Law No. 6 of 2017 in Ekiti State.
One of the victims stated, "Myself and four other family members traveled to Ado Ekiti from Ijebu Remo, Ogun State. A relative employed at Ekiti State University Teaching Hospital in Ado Ekiti informed me that thefts were common in the area. He advised us to find a secure location where members of the O’dua Peoples Congress could help guide us back home."
"We were at Dallimore junction waiting for one of us who was using the restroom. Suddenly, we saw some boys who told us to lie face down, took our laptops, phones, and money, and then fled with my Toyota Corolla. I went to report the incident at the Area Command Police Station in Okesa, Ado Ekiti," she said.
The prosecutor, Taiwo Ariyo, presented four witnesses and submitted the defendants' statement, a shotgun, three cartridges, two blue berets, and a bond to produce along with photographs as evidence.
The accused, who presented their defense through their attorney, S.K. Idowu, did not call any witnesses.
In the ruling, Judge Adekunle Adeleye determined the defendants were guilty and imposed the relevant sentence.
Adeyeye stated, "Based on the details of this case, there is no question that the defendants worked together to carry out an armed robbery. They not only stole from their victims but also admitted how they divided the stolen goods. There was a mutual agreement in committing the crime they are accused of, and each of them participated in distributing the loot."
"In the given situation, all seven accused are now sentenced to death," the judge stated.
